PLEASE READ CAREFULLY — THIS IS A LEGAL DOCUMENT.

By booking a session, entering the facility, or participating in simulator activities at OnPar Sim Club, LLC, you acknowledge that you understand and agree to the following:

1. Assumption of Risk

I understand that participation in golf simulator activities involves inherent risks, including but not limited to:

-Being struck by golf clubs, golf balls, or flying objects

-Slips, trips, and falls

-Muscle strains, sprains, joint injuries, and physical exertion injuries

-Equipment malfunction or improper use

-Injuries caused by other participants

I voluntarily assume all risks of injury, illness, property damage, or death that may occur while on the premises of OnPar Sim Club, LLC.

2. Release of Liability

In consideration of being allowed to participate, I hereby release, waive, discharge, and hold harmless OnPar Sim Club, LLC, its owners, affiliates, and representatives from any and all claims, liabilities, damages, demands, actions, or causes of action arising out of or related to any injury, accident, loss, or damage I may sustain while using the facility. This includes claims arising from negligence to the fullest extent permitted by Alabama law.

3. Responsibility for Damage

I understand and agree that I am financially responsible for any damage I cause to the facility, simulator equipment, or property due to negligence, misuse, reckless behavior, or failure to follow facility rules.

This includes damage to:

-Simulator screens and enclosure walls

-Mats and turf areas

-Sensors and cameras and launch monitors

-Projectors and computers and monitors

-Walls, ceilings, furniture, or other facility property

I authorize OnPar Sim Club, LLC to charge my payment method on file for repair or replacement costs if necessary.

4. Medical Fitness

I confirm that I am physically capable of participating and do not have any medical condition that would prevent me from safely using the simulator facility.

5. Intoxication Policy

I understand that if I am intoxicated or under the influence of drugs or alcohol, I may be denied entry or removed from the facility without refund.

6. Minors

If the participant is under 18 years of age, a parent or legal guardian must accept this waiver on their behalf. The parent/guardian assumes full responsibility for the minor’s participation.

7. Rules & Conduct

I agree to follow all facility rules and facility instructions. I understand failure to comply may result in removal from the premises without refund.

8. Photo & Video Consent

I understand the premises may be monitored by security cameras. I grant permission for OnPar sim Club, LLC to use photographs or video recordings taken during participation for promotional purposes unless I provide written notice refusing consent.

9. Governing Law / Venue

This waiver is governed by the laws of the State of Alabama. Any legal action must be brought in a court located in Madison, Alabama.

10. Agreement & Acknowledgment

By booking a session or entering the facility, I acknowledge that:

-I have read and understood this waiver

-I understand I am giving up certain legal rights

-I accept these terms voluntarily
